Florida Methylone Laws

For about a decade, the media has been warning of the dangers of a drug called “molly,” which may or may not be the same thing as MDMA, which may or may not be the same thing as “ecstasy.”   Especially when it comes to pills and powders sold on the Internet, it is hard to tell exactly what you are buying, so you might be in for an unpleasant surprise when a forensics lab sends your criminal defense lawyer a report saying that the drugs that the police confiscated from your car contained a more dangerous substance than you thought you had bought.  Several years ago, when the Miami Herald ran a series of articles about the trafficking of methylone pills into Florida by way of online purchases and shipments from China, it tended to use the terms “molly” and “methylone” synonymously.  The only way to tell the difference between MDMA and methylone is to consume them or to test their chemical composition, but both drugs are Schedule I controlled substances.  If you are being accused of possession of MDMA, methylone, or another empathogen, contact a Florida drug offenses attorney.

What Are Empathogens, and Why Are They So Illegal?

MDMA and methylone, along with GH and several other drugs are described as empathogens or entactogens because their main effect is to increase feelings of sociability or social connectedness, although some of them also have stimulant or hallucinogenic effects.  Researchers have investigated the potential of empathogens such as MDMA to treat post-traumatic stress disorder (PTSD) and other psychiatric conditions.  Methylone was first synthesized in 1996 with the goal of seeking approval for it as an antidepressant, but it has never received FDA approval.

In 2011, methylone and other empathogens became prevalent in the drug supply; these included a variety of synthetic cathinones, which are so called because their effects resemble those of the khat plant found in Yemen and East Africa.  The media often referred to these substances as “bath salts” and told sensationalized stories of terrible things that happened as a result of people consuming them knowingly or unknowingly.  Florida law categorizes methylone and five other substances as bath salts and classifies them as Schedule I controlled substances, which means that they are not legal for any medical uses.  Methylone is only about a third as potent as MDMA, although they are equally illegal.
