Man Acquitted of Trafficking Flakka After His Lawyers Establish Reasonable Doubt That He Knew What Was in the Packages

What happens if you get criminal charges because the police find drugs in your possession, and it is the first you ever found out about having any drugs?  You can win your case if you can argue that the drugs don’t belong to you.  You could also argue that they are not drugs, but what happens if investigators conduct a lab test and it turns out that the substance that the police confiscated from your house or car does contain an illegal drug?  You can argue that you did not know that the item contained drugs, especially if someone else gave it to you and promised to come back to get it.  Which defense to use if you are accused of possessing or transporting controlled substances depends on the specific details of your case and requires the expertise of a Florida drug crimes defense lawyer.

Jury Finds Defendant Not Guilty of Drug Trafficking

When Miguel Granda and Eudora Romero were in high school, they were introduced to each other and to drugs.  Years later, Granda was struggling with addiction and struggling financially, and Romero had entered the lucrative business of trafficking in designer drugs that she bought online.  Romero agreed to pay Granda $250 every time he received a package that Romero had sent to Granda’s house in western Miami-Dade County.  The packages had Chinese return addresses, and Granda gave them to Romero without opening them.  In connection to these packages, Granda was arrested and charged with drug trafficking, importation, and conspiracy; the packages Granda had received on Romero’s behalf contained a total of more than four pounds of blue flakka.

Romero testified against Granda at his trial, claiming that he must have known that the packages contained drugs, since he knew that Romero was a drug dealer.  Granda’s lawyers argued, however, that Granda had no idea what was in the packages and could not have known for certain what was in them, even if he may have suspected that they contained drugs, since he never opened them.  The jury returned a verdict of not guilty.

What Is Flakka?

Flakka is a synthetic drug that first appeared in the United States as a street drug in 2014, although it was first synthesized in the 1960s.  It is also sometimes known as “bath salts” because synthetic drugs are sometimes sold online and shipped by mail with misleading labels.  It has stimulant and hallucinogenic effects and has been known to cause fatal overdoses.  It is a Schedule I controlled substance in Florida, which means that it is always illegal and has no indications as a prescription drug.
